User agreement

This agreement sets out the terms and conditions that you agree to when using our website or services. Certain information is incorporated by reference.

Definitions

In this agreement :

Buyer: means a user who purchases services from a seller. The same user may be both a buyer and a seller.

User Agreement: includes (1) this Agreement; (2) the Code of Conduct, as updated from time to time; (3) any contractual provisions agreed between the Seller and the Buyer and published on the Website, provided that they are not inconsistent with this Agreement and the Code of Conduct; (4) the specific terms and conditions of a project as allocated and accepted on the Website, provided that they are consistent with this Agreement and the Code of Conduct; and (5) any other documents incorporated by reference.

Account: refers to the user account associated with an email address.

Dispute Resolution Process: means the process to be followed by Buyers and Sellers in accordance with the Dispute Resolution Services.

Inactive Account: means any User Account that has not been used for a period of six months or such other period as we may determine.

Intellectual Property Rights: includes all rights relating to intellectual property worldwide, including: (a) patents, copyrights, rights in circuit diagrams, registered designs, trade marks (whether registered or not) and the right to confidentiality of information; and (b) any application or right to register such rights, whether or not recognised under Cameroonian law.

Local employment or Local jobs: service enabling a buyer to be put in touch with a seller for the provision of services specific to a given location.

Freeworkerhub: platform giving companies access to a global network of freelancers.

Milestone Payment: payment made by the Buyer for the Seller’s services under a User Agreement, released in accordance with the terms specified in the ‘Milestone Payments’ section of this Agreement.

Project or Advertisement: means a job offered or awarded via the Website, including services purchased or awarded by a Buyer from a Seller.

Seller: user offering services on the website. A user can be both a buyer and a seller.

Verified by Freeworkerhub: status given to users who have met the identity verification and know-your-client requirements.

Seller services: all the services offered by a seller.

Independent Services: services provided by the Freeworkerhub platform.

User, you, your: any natural person visiting or using the Website.

Website: refers to the platforms operated by Freeworkerhub, accessible at freeworkerhub.com.

  1. Overview

By accessing the Freeworkerhub website, you agree to the following terms and conditions.

We reserve the right to modify this user agreement and any related information by posting updates on the site without prior notice.

Freeworkerhub is an online platform allowing users to buy and sell services. To carry out transactions, buyers and sellers must create an account. The site facilitates contact between the parties for the completion and payment of projects, but does not intervene in the contracts concluded between them.

We also reserve the right to modify or add features, products or services to the website at any time and without notice. However, we do not guarantee that the information on the website will be continuously updated and accept no liability for any errors or out-of-date data.

  1. Scope

Before using the Website, you must read the entire User Agreement and the associated policies.

By accessing our platform, you agree to all the terms of the User Agreement, the Code of Conduct, the Privacy Policy and other applicable policies.

These conditions apply to each use of the website or the tools made available to interact with it. Certain specific services may be subject to additional conditions, which will be communicated to you where applicable.

  1. Eligibility

Access to the website is prohibited to persons who:

  1. Are not in a position to enter into legally binding contracts;
  2. Are under 21 years of age;
  3. Are prohibited from providing or receiving services by law or by a final court decision;
  4. Have been suspended from the website;
  5. Do not have a valid e-mail address.

Each user account is strictly personal and must not be shared. The user associated with the account is responsible for all actions carried out via the account.

Users may associate a trade name or company name with their account. However, the contract of use remains with the natural person holding the account, who remains solely responsible for his or her activities on the platform.

Legal entities (companies, associations, trusts, etc.) may also use the site subject to an appropriate professional subscription.

We reserve the right to accept or refuse a user’s registration at our sole discretion.

Finally, the rights and obligations arising from this contract may not be transferred or assigned without our prior written consent.

  1. Use of Freeworkerhub

When using the Website, you undertake not to do or attempt to do any of the following:

  1. Publish content or items in inappropriate categories or sections;
  2. Infringe applicable laws, the rights of third parties or the site’s policies, including the Code of Conduct;
  3. Not honouring payment for services received;
  4. Fail to deliver services ordered from you as a seller;
  5. Circumvent or manipulate Freeworkerhub’s pricing structure, billing process or any fees applicable to Freeworkerhub;
  6. Publish content that is false, misleading, defamatory, offensive, or contains unauthorized personal information;
  7. Undermine the site’s rating or reputation system (e.g., manipulation of reviews, misuse of ratings);
  8. Transfer your Freeworkerhub account, including your reviews and username, to another person without our consent;
  9. Distribute or publish spam, unsolicited communications, chain letters or pyramid schemes;
  10. Distribute viruses or any other technology harmful to Freeworkerhub, the Website or its users, or post any content that is unlawful, threatening, vulgar, defamatory, obscene, hateful or invasive of another’s privacy;
  11. Extract or republish lists from the website on other platforms without our prior written authorisation, nor integrate in any way part of the website on another website without our prior agreement;
  12. Modify, translate, decompile, disassemble or attempt to analyse the operation of any software used by Freeworkerhub;
  13. Copy, modify or distribute any content, copyright or trademark owned by Freeworkerhub;
  14. Collect or use users’ personal information, including e-mail addresses, without their consent;
  15. Use Freeworkerhub for unauthorised monetary exchanges, including those involving cryptocurrencies (Bitcoin, Ethereum, etc.).
  16. Infringement of intellectual property rights

We take the protection of intellectual property rights very seriously. We are committed to investigating all clear and detailed reports of suspected infringement. In order to limit fraudulent or inaccurate reports, we have set up a simplified procedure.

If you believe that your rights have been infringed, please inform us via the dedicated link on our website. An investigation will be carried out as soon as possible.

  1. Fees and services

The use of certain services on Freeworkerhub may entail charges, in particular for the connection of projects, advertisements and subscriptions.

Before accessing a chargeable service, you will have the opportunity to consult and accept the applicable charges, as defined in our price list. These charges may be revised at any time and will be updated directly on our website.

From time to time, we may offer promotional discounts on our services (e.g. discounted membership offers), which will come into effect as soon as they are published on the website or by specific notification.

Unless otherwise stated, all fees are expressed in CFA Francs.

  1. Taxes

You are responsible for paying any applicable taxes (VAT, goods and services tax, etc.) in accordance with the tax regulations in force in your jurisdiction.

Depending on your country of residence or location, certain taxes may be added to the fees charged by Freeworkerhub.

You also acknowledge that you are responsible for complying with your local tax obligations, including those relating to income tax.

In some cases, vendors registered or required to be registered as VAT collectors may be required to charge VAT to consumers on certain projects. You will be informed of this and will be asked to confirm its application when the project in question is awarded or accepted.

  1. Promotions

Unless you request otherwise in writing and we accept your request, we may display your company name, logo, images or other visual material as part of our independent services and website marketing campaigns.

In addition, you agree that the public description of your projects and your profile information may be used for promotional and related purposes.

  1. Content

Although we do not claim any ownership rights in your User Content, you grant us a worldwide, non-exclusive, transferable, irrevocable, royalty-free licence to use, reproduce, distribute, modify, adapt, publish, display and exploit such User Content, in whole or in part, in any medium now known or hereafter devised, without limitation in time or obligation to notify you of any such use. This licence allows us to use, reproduce, distribute, modify, adapt, publish, display and exploit this content, in whole or in part, in any existing or future media, without any time limit or obligation to inform you or pay you.

You acknowledge and agree that:

  1. We act as a publishing platform and do not guarantee the availability of your content on the Website.
  2. We are not responsible for the deletion or possible loss of your content.
  3. All content submitted is subject to our approval and may be modified, accepted or rejected at our discretion.

You guarantee that your content :

– Does not infringe any intellectual property right, right to privacy or right of publicity of any third party.

– Does not contravene any applicable law or regulation.

– Is not defamatory or libellous.

– Is not obscene or pornographic.

– Is not linked to the design, manufacture or distribution of weapons or dangerous substances.

– Is not linked to terrorist activities.

– Does not contain false, misleading or incomplete information.

– Does not include any viruses or malicious programs.

You also agree that we may transfer your personal information to an affiliated entity, including outside Cameroon. If you withdraw your consent, we may no longer be able to provide you with access to the Website and may close your account.

9.1 Third party information and content

The information available on the Website is general and does not constitute professional legal, financial, health or other advice. For any specific question, we recommend that you consult a qualified professional.

We permit the publication of third-party content, including user reviews and external articles. We act solely as an intermediary and accept no responsibility for such content.

In addition, the website may contain links to third-party sites, the content and practices of which we have no control over. Access to and use of these sites is at your own risk.

9.2 Retention and deletion of information

The deletion or masking of content on the Website does not guarantee its permanent deletion. Certain information may be retained temporarily to meet legal, regulatory or administrative obligations.

  1. Comments, reputation and opinions

By posting a comment, rating or review on our site, you automatically transfer to us the copyright in it, including the ratings given (quality, communication, etc.) and any composite ratings we generate. These elements become our exclusive property, although we allow you to use them as long as you remain a user of the site. You may not exploit or use these reviews, reputations and ratings in any way that is contrary to our policies, except with our prior written permission.

You must not take any action that may compromise the integrity of the Freeworkerhub feedback system. In the event of suspected abuse or manipulation of this system, we reserve the right to suspend or terminate your account at our sole discretion.

Our ratings are exclusively intended to facilitate interaction between sellers and buyers on our platform. You may not use your ratings, whether as a seller or a buyer, for any other purpose (including commercial purposes) or outside the websites operated by Freeworkerhub, unless you have given us your prior written consent.

  1. Advertising

Unless specifically agreed with us, you are not authorised to promote an external website, product or service on our platform. Any URL published on the site must be directly linked to a project, article, user or service offered on our website.

We reserve the right to display advertisements and promotions on the platform. You agree that we shall not be liable for any loss or damage arising from the presence of such advertisements or from any interaction with third party advertisers. Furthermore, you acknowledge that such advertising content may be protected by intellectual property rights (copyright, trademarks, patents, etc.). Except as expressly authorized by Freeworkerhub or the rights holder, you agree not to modify, sell, distribute or exploit these advertisements and promotions.

  1. Communication with other users

All interactions with other users must take place via the text, audio or video chat functionalities available on the Website, as well as via the discussion forums, public clarification boards, direct messages and other channels provided by the platform.

You may not publish your email address or any other contact information (such as your Skype, Facebook or other platform ID) on the Website unless explicitly requested in the dedicated field of the registration form or authorised by Freeworkerhub.

Unless you have a prior relationship with another user, you must limit your communication with them to the Website channels. It is strictly forbidden to communicate by any other means (e-mail, telephone, Skype, Facebook, WhatsApp, etc.), under penalty of sanctions. Any communication or transaction carried out outside the platform may result in a penalty.

For audio and video chat, all conditions agreed between users must be confirmed in writing using the internal messaging system.

Freeworkerhub may use certain information about you (name, location, username, profile picture, etc.) to ensure the proper functioning of its messaging system. We reserve the right to monitor correspondence exchanged on the platform and to analyse any file, programme or link shared in order to prevent fraud, ensure regulatory compliance and manage risk.

  1. Identity verification (‘Know Your Customer’)

You authorise Freeworkerhub, directly or through third party service providers, to carry out any verification necessary to confirm your identity. At our request, you must:

  1. Provide additional information (such as your date of birth) to facilitate your identification.
  2. Confirm ownership of your e-mail address or means of payment.
  3. Verify your data using third-party databases or other sources.

You may be required to provide supporting documentation, such as a passport or driving licence. In some cases, we may require photographic verification with a code provided or a video interview to validate your identity, qualifications and background.

If we are unable to verify your information to our satisfaction, we reserve the right to suspend, restrict or close your account.

We may also update your details on the platform to match the documents provided. Payments to you will only be made in the name that matches the verified information.

Failure by Freeworkerhub to verify your identity may restrict certain features of your account, including cash withdrawals. Please see our Identity Verification Policy for further details.

  1. User Services

When a buyer assigns a project to a seller and the seller accepts it via the platform, a User Agreement is automatically concluded between them, committing the buyer to order the service and the seller to perform it. You undertake not to enter into any agreements contrary to this contract.

You are solely responsible for fulfilling your obligations to other Users. If you fail to do so, you may be liable for the legal consequences. It is your duty to inform yourself of the laws and regulations applicable to your status (buyer or seller) and to the use of the website.

If a user does not respect their obligations towards you, it is up to you to assert your rights. Freeworkerhub cannot be held responsible for the application of contracts between users.

Depending on their jurisdiction, buyers and sellers may benefit from legal guarantees that cannot be excluded. This User Agreement respects these rights and is not intended to violate abusive contract regulations. Any provision in conflict with local laws shall be construed in accordance with those laws, without exceeding their limits.

Buyers and sellers recognize that their relationship is one of independent entrepreneurs. Nothing in this agreement creates a partnership, joint venture, agency or employment relationship between the users, nor between Freeworkerhub and its users.

  1. Specific provisions for local jobs

Each user acknowledges that:

  1. Freeworkerhub does not verify, endorse, recommend or certify the claimed qualifications, licenses or skills of users for local jobs (or any other type of job offered on the platform).
  2. Freeworkerhub acts solely as a matchmaking platform and cannot be held responsible for the performance of services or interactions between buyers and sellers. Freeworkerhub does not involve itself in disputes between the parties, but offers a dispute resolution mechanism.
  3. The platform can incorporate mapping features that display users’ location. Purchasers requesting services for local works must indicate the project location. Freeworkerhub is not responsible for the visibility of this information.
  4. Users should never include personal information (name, address, phone number, email, etc.) in the public description of a local project. However, this data can be shared in a private message if necessary.
  5. Freeworkerhub may collect and use your location data via various technologies (GPS, IP address, Wi-Fi, etc.) to facilitate local jobs. You expressly consent to such collection and use under this agreement.
  6. Once a local job has been completed, the seller must log in to the site and click on “Finish” as soon as possible.
  7. Failure to comply with this obligation constitutes a breach of this User Agreement.
  8. The service fee is deducted from the amount of the bid accepted by the seller. The purchase of equipment necessary for the execution of the project is under the sole responsibility of the buyer and seller.
  9. Management of funds

You may have positive funds in your account if you have paid for services in advance or if you are a seller who has completed a project and received the corresponding payment.

These funds are held by Freeworkerhub on its operating bank accounts, where they may be merged with other user funds and the company’s own funds. They are neither separated nor individually guaranteed.

You are not entitled to any interest on these funds. Any interest collected on these amounts belongs exclusively to Freeworkerhub.

If your account shows a negative balance, Freeworkerhub may:

  1. Offset this amount with the funds you will receive at a later date.
  2. Convert and use your available funds in other currencies at an exchange rate set by Freeworkerhub.
  3. Cancel certain payments you have made to other accounts on the platform.
  4. Deduct amounts owed from funds added or received later.
  5. Suspend or limit your account until regularization.

Any compensation made may be cumulated with other debits. Freeworkerhub reserves the right to take any legal action necessary to recover the amounts due.

By using Freeworkerhub, you acknowledge and agree that:

  1. Freeworkerhub is not a bank or financial institution and does not provide any banking services.
  2. The funds displayed in your account constitute a non-guaranteed obligation of Freeworkerhub to you, not a protected deposit.
  3. If your account was migrated from another platform during an acquisition, Freeworkerhub’s liability for your funds will be limited under the terms of the migration agreement.
  4. As long as the funds have not been transferred to you, Freeworkerhub acts as a chirograph creditor.
  5. Freeworkerhub does not assume any fiduciary role on the funds held.
  6. The amounts in your account are not covered by a financial guarantee or deposit insurance.
  7. Only payment tools integrated into the platform shall be used for transactions.
  8. Any refund will only be made to the original payment source and cannot be redirected to another payment method.
  9. Funds held on the platform may be used to pay other users or for general business purposes, without prejudice to Freeworkerhub’s obligation to release or refund amounts as directed by you.
  10. Limits and fraud prevention

Freeworkerhub reserves the right to suspend any request for withdrawal if the origin of the funds is deemed suspicious.

If funds were transferred as a result of a fraudulent transaction, we will immediately cancel the transaction. If these funds have already been paid into your account, you are required to return them. In the event of a non-refund, we reserve the right to suspend, limit or delete your account and take action to recover these funds.

We may, in our sole discretion, restrict access to all or part of your account funds (preventing their use) in the following situations:

  1. An unacceptable level of risk is detected on your account or transactions (including cancellation and chargeback risks).
  2. We have reason to believe that the payment is intended for a third party other than you.
  3. Payment is made to a country where our service is not available.
  4. The law or a competent authority imposes this restriction on us.

In the event of a dispute, a temporary limitation of funds may be applied to cover any liability. If the dispute is resolved in your favour, the restriction will be lifted and the funds will be returned to you. If not, Freeworkerhub may withdraw funds from your account.

In addition, we may restrict your account if we suspect fraudulent activity or violation of our terms of use, while conducting an investigation.

  1. Refunds

You may request a refund of any funds you have deposited into your account at any time, unless:

  • The funds are linked to a milestone payment subject to section 25.
  • Funds are fees or charges due to Freeworkerhub.

If the request is for a milestone payment (section 25), you must follow the dispute resolution procedure. If it concerns fees and charges, the procedure indicated in the “Disputes with us” section applies.

If the refund is accepted, the funds will be refunded using the same payment method as the one used initially.

We may also refund, even without your request, if:

  1. We are required by law to do so or we believe that a refund is legally necessary.
  2. This avoids litigation or limits our costs.
  3. Reimbursement is provided for by our internal policies.
  4. The initial payment was made fraudulently.
  5. A double payment was made by mistake.
  6. We believe a refund is necessary to avoid credit card chargeback.

Refund requests must be made via our customer support site or by email to [email address].

Once a milestone payment (section 25) is made, you agree to follow the dispute resolution process and comply with its decision, without resorting to a chargeback request from your credit card issuer.

If you initiate a chargeback request or similar process, we reserve the right to provide all necessary information to the parties concerned to challenge this request.

If you have already initiated a chargeback with your bank, you should not request a refund from Freeworkerhub to avoid double refunds.

If we find an excessive or abusive number of requests for refunds or chargebacks from you, we reserve the right to suspend, limit or close your account.

  1. Withdrawals

The first withdrawal of earned funds may be delayed up to 15 days for security and fraud prevention reasons. Later, similar delays may occur if our anti-fraud policies require it.

A minimum withdrawal amount can be applied for the available funds, and the maximum amount you can withdraw per month is 5,000,000 CFA francs, unless a specific agreement with the support modifies it.

We may require verification of your identity by Freeworkerhub before allowing your funds to be withdrawn, whether or not a delay has been applied. You agree to provide the information necessary for this verification as part of our anti-fraud policy and to comply with the “Know your customer” obligations as set out in the dedicated section of this agreement.

  1. Chargebacks

Chargebacks, that is, disputes of payments by the user with their card issuer or financial institution, are managed by the issuer of the payment product or third parties, such as payment processors, and not by us. We must follow their instructions.

You acknowledge that we have the right to recover all chargebacks and cancellations imposed by the payment product issuer or third parties, in respect of the funds we have paid to you, and any processing or other costs incurred as a result of these chargebacks.

If a chargeback or cancellation is made, we may cancel the associated payments. If you initiate a chargeback or other similar process, you consent to us sharing all information necessary for the failure of that request in accordance with the terms of this agreement.

  1. Non-circumvention and Off-Platform Engagement

No-Circumvention Period: Unless otherwise agreed in writing, for 24 months from the first meeting or presentation of a Seller via the Website (the “No-Circumvention Period”), you agree not to attempt to engage this Seller outside the Website without respecting this clause.

Corporate Customers: If you are a Corporate customer, as defined in your Master Agreement or User Agreement, these terms and conditions apply to any non-circumvention provisions. In case of conflict between these conditions and your framework contract, the latter will prevail.

Off-platform engagement during the non-circumvention period: Before the end of this period, you may request to engage a Seller outside of the Website. If Freeworkerhub accepts, you will be required to pay a “Conversion Fee” for the site’s facilitation as described in the following paragraph.

Conversion fee calculation: If you engage a Seller outside the Website before the end of the non-circumvention period, the conversion fee will be the highest between:

  • Fees applicable under the current Terms and Conditions (up to 30% of the annual remuneration of the seller and/or 700,000 CFA francs per offence), or
  • 13% of 5,000,000 CFA Francs multiplied by the applicable hourly rate of the Seller, calculated on the basis of the Seller’s public hourly rate or the most recent rate paid via the Website.

Exclusions after the non-circumvention period: After the end of the no-circumvention period, you may engage the Seller outside of the Website without any conversion fees.

No employment relationship: This clause does not imply the creation of an employment relationship between you, us or the Seller. It is solely designed to fairly compensate Freeworkerhub for its services and preserve the integrity of the Website.

Enforcement and redress: Any violation of this clause may result in the immediate suspension or termination of your account. We reserve the right to request payment of conversion fees and associated collection costs.

  1. Inactive accounts

User accounts that remain inactive for an extended period may be subject to monthly maintenance fees, covering costs such as storage, bandwidth, support and management related to hosting the user’s profile, Portfolio storage, listing in directories, profile promotion on the site and elsewhere, file storage, message transmission, general administrative matters and message storage, among others.

The duration of this period of inactivity and the amount of maintenance fees are detailed in our fee schedule. We reserve the right to close an inactive account. In addition, we also reserve the right to close an account with a zero or negative balance.

  1. Right to refuse service

We reserve the right to close, suspend or limit access to your account at our discretion without obligation of justification. However, we may carry out these actions in the following cases:

  1. If we determine that you have violated this User Agreement;
  2. If you underbid on a project for the purpose of privately renegotiating the price to avoid fees;
  3. If we establish that you have violated legal rights (including intellectual property rights violation) resulting in actual or potential claims;
  4. If we discover that you are involved in fraudulent or illegal activities;
  5. If you do not respond to requests to verify your account;
  6. If you do not complete your account verification within 3 months of the request;
  7. If you are subject to an applicable penalty regime or if our banking relationships prevent us from doing business with you;
  8. To manage any risk of loss for us or any other party;
  9. For other reasons.

If you close your account for breach of this agreement, you may be liable for certain fees described in this agreement.

In addition, should you breach this contract, you are responsible for reimbursing us for all costs due and covering all losses and costs associated with the investigation of the breach, as well as reasonable expenses (including legal fees).

You acknowledge that the damages resulting from your breach of contract will be substantial and may include fines and other fees imposed by our payment processors or our users. These damages may be difficult to establish, but a fine of up to FCFA 700,000 for each violation could be imposed.

If your account is closed for any reason other than your violation, you will still be able to receive any payment due to you.

In any case, you will not be able to make any claim against us regarding the suspension or termination of your account.

  1. Milestone payments

Subject to the User Agreement, the Buyer may make an interim payment, which will be locked into his account and may only be claimed by the Seller in one of the following cases:

  1. Buyer and Seller agree that the funds may be claimed by the Seller;
  2. In the event of a dispute, if the resolution of the disputes has been successful in favour of the Seller;
  3. If the Buyer requests us to pay the Seller for services provided as part of a project;
  4. If the Buyer acknowledges that the Seller has delivered the services in a complete and satisfactory manner.

If the Buyer does not approve of the work provided by the Seller, both parties can resolve the issue as part of the dispute resolution process.

If no dispute or instruction is received from the Buyer or the Seller regarding a milestone payment within six months (or other reasonable time) and the Buyer has not logged into its account during that period, the payment step will be released and returned to the Buyer.

  1. Conditions of release

The “Release Conditions” refer to the following situations in which funds may be released:

  1. Buyer clicks to release funds to seller.
  2. If the buyer does not take any action for 14 days after the seller’s release request, the funds will be automatically released by Freeworkerhub in favor of the seller.
  3. If the seller cancels the contract before a milestone payment is made, the funds will be returned to the buyer.
  4. If the buyer and seller submit joint written instructions to release the funds into the seller’s or buyer’s escrow account, as applicable.
  5. If the buyer and seller agree to close the contract without releasing the funds, the funds will be returned to the buyer.
  6. If the buyer or seller does not pay their share of the arbitration fee, the funds will be allocated to the party making the payment.
  7. If the buyer and seller do not submit to arbitration on time to resolve an unresolved dispute, funds will be awarded to the buyer.
  8. If the buyer or seller does not respond to a notice from the dispute resolution service in a timely manner, the funds will be paid to the responding party.
  9. If the buyer or seller does not comply with the dispute resolution service, funds will be paid to the compliant party.
  10. If a final award of an appointed arbitrator is rendered, the funds will be released in accordance with that award.
  11. If a court of competent jurisdiction makes a final order without appeal, the funds will be released under that order.
  12. If Freeworkerhub determines, in its sole discretion, that a fraud, non-payment, illegal act or breach of the terms of use is underway or has occurred, we may release the funds to their source of payment in order to remedy the situation.
  13. Dispute resolution services

You agree to first attempt to resolve any dispute regarding a project directly with the other user, including issues relating to the quality of services provided. If the dispute persists, we encourage you to contact us in accordance with the “Contact Us” section.

In the event of a dispute, Freeworkerhub will have all rights and powers to make a decision on that dispute. We may ask the seller and buyer to provide supporting documentation for their position. You agree that Freeworkerhub has full discretion to accept or reject the submitted materials. You also acknowledge that Freeworkerhub is not a judicial institution and that our decisions will be made in a reasonable manner, without guaranteeing the accuracy of the documents provided. You agree to indemnify Freeworkerhub for any misrepresentation or deception in the documents provided by the parties to the dispute.

If a dispute arises between you and another user of the site, you agree to indemnify Freeworkerhub for any claims, demands, damages or costs related to that dispute or our decisions.

The Freeworkerhub Code of Conduct applies to all our services. You agree to act honestly and make reasonable requests and offers. Any threatening, blackmailing, intimidating or encouraging users to leave positive comments will not be tolerated. Users who violate the Code of Conduct during dispute resolution proceedings may lose the dispute and be subject to additional disciplinary action.   1. Disputes with Freeworkerhub

In the event of a dispute between you and Freeworkerhub, we undertake to respond promptly to your concerns. If we are unable to resolve the issue to your satisfaction, we will provide you with a means of resolving the dispute as soon as possible. For any claim, Freeworkerhub may choose to resolve the dispute by binding arbitration without appearance. If Freeworkerhub opts for arbitration, it will be arranged by an alternative dispute resolution (ADR) provider that you must select from a list provided by us.   1. a) It may be done by telephone, online, or only on the basis of written submissions, according to the method chosen by the party initiating the arbitration.

All claims filed against Freeworkerhub shall be resolved in accordance with this Agreement. Claims made in violation of this Agreement will be deemed inappropriate. If you file a claim against this Agreement in an inappropriate manner, Freeworkerhub may recover its legal fees, including internal attorney’s fees, if you do not promptly withdraw your claim after being notified.

You agree not to pursue any claims against Freeworkerhub collectively or seek to coordinate or consolidate any arbitration or action under this Agreement with other proceedings.

If a proceeding is commenced under any bankruptcy or insolvency law, Freeworkerhub may recover all reasonable costs and expenses, including legal fees, related to the enforcement of.

  1. Currency

Some sites may display rates in local currency in addition to the original, based on market exchange rates. You agree that these rates are indicative and that the actual amount is in your home currency.

Any notification sent to Freeworkerhub must be sent by registered mail (or by registered air mail if sent from outside of Cameroon).

This agreement will be governed by the laws of Cameroon. We encourage you to attempt to resolve disputes through certified mediation. If the dispute cannot be resolved, you and Freeworkerhub irrevocably submit to the non-exclusive jurisdiction of the courts located in Yaoundé, Administrative Centre, Republic of Cameroon.

  1. Divisibility

The provisions of this User Agreement are independent. If a provision is found to be invalid or unenforceable, that provision will be deleted and the remaining provisions will continue to apply. We reserve the right to assign this agreement to any associated entity or third party, without your consent, in the event of sale or transfer of all or part of our assets. In such case, you will remain bound by this User Agreement.

  5. Abuse or misconduct with any member of staff, including inappropriate or unreasonable communications
  6. Poor performance or abuse of services
  7. Any attempt to use the Freeworkerhub platform or services for malicious purposes
