Our privacy obligations

Freeworkerhub.com ‘ Freeworkerhub ’ is governed by the Laws and Regulations of Cameroon. These include the Law on Cybersecurity and Cybercrime, the Law on Electronic Commerce, the Law on Electronic Communications, the Law on the Protection of Personal Information, the Law on Consumer Protection and subsequent regulations to ensure the protection of personal information. The aforementioned texts regulate the way in which personal information is processed by Freeworkerhub.com.

‘Personal information’ means information about, or an opinion of, an identified individual or a reasonably identifiable individual. Freeworkerhub’s privacy policy applies to personal information collected and/or held by Freeworkerhub.

This Privacy Policy also explains how we handle ‘personal data’ relating to persons residing in Cameroon or performing work in Cameroon.

We will review this policy regularly and may update it from time to time.

The types of personal information we collect and hold

We collect personal information about our users in order to provide our services and customer support. Our services and customer support are provided via our website, and possibly our applications. The specific platform and service or media with which you interact may affect the personal data we collect.

Not all information requested, collected and processed by us is ‘Personal Information’ because it does not identify you as a specific natural person. This will include the majority of ‘User Generated Content’ that you provide to us with the intention of sharing with other users. This ‘non-personal information’ is not covered by this Privacy Policy. However, because non-personal information may be used in aggregate form or linked to existing personal information, in that form it will be treated as personal information. As such, this Privacy Policy will list both types of information in the interests of transparency.

In some situations, users may provide us with personal information without our request or by means not intended for the collection of particular types of information. Although we may take reasonable steps to protect this data, the user will have circumvented our systems, processes and controls and the information provided will not therefore be governed by this Privacy Policy.

In some situations, users may provide us with personal information on platforms beyond our control; for example via social networks or forums. Although any information we collect will be governed by this Privacy Policy, the platform through which it is provided will be governed by its own privacy policy.

How we collect personal information

Information you specifically provide to us

While using our products and services, you may be asked to provide certain types of personal information. This may happen via our website, apps, phone or paper forms. At that time, we will provide you with a collection notice to explain how we will use the personal information we request. The notice may be written or verbal.

We may request, collect or process the following information:

Account details – username, password, profile picture.

Contact details – email address, telephone number.

Location details – physical address, time zone.

Identity details – full name, proof of identity (e.g. driving licence, passport), proof of address (e.g. utility bill), photograph of user.

Financial information – credit card details, bank transfer details, payment processor details (e.g. Paypal), tax numbers.

User-generated content – project descriptions and attachments, offer descriptions, user profiles, user reviews, competition descriptions and attachments, user messages, etc.

Information we collect from third parties

Users may allow us to connect to their accounts on other platforms to collect personal information. This includes, but is not limited to, Facebook, LinkedIn and Google. The information collected will be governed by this privacy policy. Users can prevent us from collecting data on other platforms by removing our access on the other platform or by contacting our support team.

Users have the ability to invite non-users to our platform by providing contact information such as email address. In these situations, information will be collected and stored by us to contact the non-user and prevent abuse of the invitation systems.

Your payment provider may transmit payment information that we may collect or process.

In some situations, users’ personal information may be collected from public sources.

We may collect or process the following information:

Basic details – username, profile picture.

Contact details – email address, telephone number.

Location details – physical address, time zone.

Financial information – payment account details (e.g. Paypal email address and physical address) and bank transfer details.

Contact list – email provider’s address book.

User-generated content – user profile.

Information we collect when you use our service

We keep records of the interactions we have with our users, including the products, services and customer support we have provided. This includes the interactions our users have with our platform, for example when a user has viewed a page or clicked a button.

In order to provide certain products or services, we may passively collect your GPS coordinates, where available on your device. Most modern devices such as smartphones will display an authorisation request when our platform asks for this data.

When we are contacted, we may collect personal information intrinsic to the communication. For example, if we are contacted by email, we will collect the email address used.

We may collect or process the following information :

Metadata: IP address, computer and connection information, referring web page, standard web log information, language settings, time zone, etc.

Device information: device ID, device type, device plug-ins, hardware capabilities, etc.

Location – GPS position.

Actions: pages viewed, buttons clicked, time spent viewing, search keywords, etc.

Links to other sites

On our website, you will come across links to third-party websites. These links may originate from us or appear as content generated by other users. These linked sites are not under our control and we are not responsible for their actions. Before providing your personal information via any other website, we advise you to examine that website’s terms and conditions of use and privacy policy.

How we use personal information

The information we request, collect and process is primarily used to provide users with the product or service they have requested. Specifically, we may use your personal information for the following purposes:

– to facilitate the signing of a Contract;

– to provide you with technical or other assistance

– to respond to requests for information about our services or to respond to a complaint;

– to promote our other programmes, products or services that may be of interest to you (unless you have unsubscribed from such communications);

– to enable debugging, testing and operation of our platforms;

– carry out data analysis, research and otherwise build and improve our platforms;

– comply with legal and regulatory obligations;

– as permitted or required by law; or

– for other purposes with your consent, unless you withdraw your consent for those purposes.

The ‘lawful processing’ purposes for which we will use our users’ personal information are (but are not limited to):

– where a user has given consent;

– where it is necessary for the performance of a contract to which the user is a party;

– processing is necessary to comply with our legal obligations;

– processing is necessary to protect the vital interests of our users or another natural person.

– processing is carried out in pursuit of our legitimate interests, where these interests do not adversely affect the rights of our users.

We use automated decisioning to help match users to jobs. This happens primarily through the way we rank users. These rankings are produced by analysing user-generated content, user activity and job results; in this context, user-generated content will include reviews that users receive when they complete jobs. Automated decision making is also used to recommend potential jobs to our users and as part of our market security systems.

By registering with us, you agree to receive SMS messages from us about marketplace activity, security measures, identity confirmation and further updates. We will never provide your information to third parties for marketing purposes.

When we disclose personal information

Our third party service providers

Users’ personal information may be held, transmitted or processed on our behalf outside Cameroon, including “in the cloud”, by our third party service providers. Our third party service providers are bound by contract to use your personal information only on our behalf, in accordance with our instructions.

Third-party applications

Through the Freeworkerhub API, users can grant third-party applications access to their Freeworkerhub account. Depending on the permissions granted, these applications can access certain personal information or perform actions on behalf of users. These third-party applications are not controlled by us and will be governed by their own privacy policies. Users can prevent third-party applications from accessing their data via their settings. 

Other disclosures and transfers

We may also disclose your personal information to third parties for the following purposes:

– as necessary to provide the service or product you have requested;

– if we receive court orders, subpoenas or other requests for information from law enforcement agencies;

– as permitted or required by law; or

– for other purposes with your consent.

Accessing, correcting or downloading your personal information

You have the right to request access to the personal information Freeworkerhub holds about you. Subject to certain exceptions, we must give you access to the personal information we hold about you within a reasonable time and at no unreasonable cost. Most personal information is accessible by logging into your account. If you wish to access information that is not accessible via the platform, or if you wish to download all the personal information we hold about you in a portable data format, please contact our Privacy Officer.

You also have the right to request correction of the personal information we hold about you. All your personal information can be updated via the user settings pages. If you need assistance, please contact our Customer Service department.

Exercising your other rights

You have a number of other rights in relation to the personal data Freeworkerhub holds about you. However, there may be restrictions on how you can exercise these rights. This is largely due to the nature of the products and services we offer. Much of the data we collect is aimed at facilitating contracts between users, facilitating payments and ensuring the protection of legitimate users of our marketplace. These uses of data are protected by the rights set out below.

You have the right to:

– request a human review of automated decision-making or profiling

– unsubscribe from direct marketing and profiling for marketing purposes

– erasure

– temporary restriction of processing.

Human review of automated decision making/profiling – In the case of our ranking algorithms, it is not possible to exercise this right as this ranking is a fundamental part of the marketplace in which users participate, unsubscribing would mean not being able to participate. Decisions affecting the security of the marketplace are already reviewed by humans.

Direct marketing and profiling: users can control the emails they receive via their settings page.

Deletion – Most personal information and user-generated content cannot be deleted as it is used to support contracts between users, document financial transactions and is used to protect other legitimate users of the marketplace. In the case of non-personal data that may be linked to personal data, it will either be deleted or anonymised from the personal data.

Temporary processing restriction – in certain circumstances, you may exercise this right, in particular if you believe that the personal data we hold is not accurate, or if you believe that we do not have legitimate grounds for processing your information. In both cases, you can exercise this right by contacting our Privacy Officer.

Whilst we endeavour to resolve complaints quickly and informally, if you wish to make a formal privacy complaint, we ask that you submit your complaint in writing to our Privacy Officer, by post or email as above. We will acknowledge receipt of your formal complaint within 10 working days of receipt.
